A ‘section 22’ application under the Proceeds of Crime Act 2002 has been refused.
The prosecution asked the court to uplift the available amount of an order made several years ago against Henry’s client.
The application would have forced the defendant’s pension to be realised prematurely, which would have drastically reduced its value.
Henry persuaded the Court to exercise its discretion in his client’s favour and not make any order – despite the difficulties often encountered in resisting such applications.
