A man convicted of attempted burglary has had his sentence reduced by the Court of Appeal.

Ilana Davis’s client had originally been sentenced to 23 months imprisonment. The Appellant had attempted to enter the garage of a home, equipped with a crowbar, when the occupiers were present. However, he abandoned his plan and walked away.

The Court of Appeal agreed with Ilana’s submissions that the sentence imposed was too high. In particular, the sentencing Judge had double-counted the fact that the occupiers were at home and did not afford sufficient reduction for the fact the offence was an attempt rather than a completed burglary.

The Appellant’s sentence was reduced to 18 months imprisonment.
