Jamie Scott successfully appeals by way of Case Stated

Jamie Scott has successfully appealed to the High Court by way of case stated in Miller v DPP [2018] EWHC 262 (Admin).

In an important judgment, Hickinbottom LJ and Dove J held that the failure of the police to contact an appropriate adult when dealing with a mentally vulnerable suspect would be a material breach if he were subsequently charged with failing to provide a specimen.

The High Court also confirmed that the appropriate means to challenge a pre-trial ruling is by way of case stated and not by judicial review, as the Respondent had contended.
