A bill giving effect to the first stage of the Law Commission’s recommendations relating to sentencing law has received Royal Assent. The Sentencing Pre-consolidation Act 2020 is the first stage of simplifying sentencing laws.
Henry Skudra was a member of the Law Commission team that worked on the project to produce the new sentencing code that has the following benefits:
- it makes the law simpler and easier to use;
- it increases public confidence in the criminal justice system; and
- it increases the efficiency of the sentencing process.
They pre-consolidation act is a ‘clean sweep’, removing unnecessary reference to historical layers of legislation. It also makes amendments needed to bring about the consolidation of sentencing Acts.
The main piece of legislation, the Sentencing Bill 2019-2021, is currently making its way through Parliament. As presently drafted, it will apply to all defendants convicted on or after the 1 October 2020.
