Andrew Davidson leading Cally Keenan secured the acquittal of a conveyancer who, with others, was accused of a series of stamp duty frauds causing a loss to both the mortgage applicant and His Majesty’s Revenue and Customs (HMRC).
The prosecution alleged that the Defendant was one of three individuals involved in the process of making fraudulent submissions to HMRC claiming that the mortgage applicants were exempt from paying Stamp Duty between March 2014 and January 2016.
The individuals, none of whom were truly exempt, were under the belief that they had paid all fees due to HMRC. The money was actually transferred to the bank account of one of the other defendants under the guise of ‘agents fees’. As a result of this the mortgage applicants were left out of pocket, and the Stamp Duty was never actually paid.
The Defendant, who had no knowledge of the fraud, was ultimately acquitted following a 43-day trial.
