Gurdeep Garcha K.C. was successful in overturning a conviction for Assault by Beating against a police officer who has served West Midlands police for over 20 years.
The officer was off duty at the time of the incident. He was alleged to have launched a wholly unprovoked assault against a female at a barbecue, where it was said he was very heavily intoxicated.
The officer was convicted by a District Judge in the Magistrates Court and appealed his conviction before Worcester Crown Court.
Following a very detailed cross-examination of the complainant, Mr Garcha K.C. was able to demonstrate that her account was flawed and unreliable. The court quashed the conviction and set aside the financial and other penalties that had been ordered when the officer was convicted.
