Henry was instructed to pursue a confiscation order against Robert Child who had murdered his mother for financial gain. Unusual issues involving the Forfeiture Act 1982 and the ambit of s76(4) POCA 2002 (ie what property was obtained ‘as a result of or in connection with the [criminal] conduct’) had to be grappled with as well as matters in relation to the severance of a joint tenancy.
As Mr Child was the beneficiary of a his mother’s will, he was prevented from inheriting directly from her estate.
A confiscation order was made in the sum of £78,589.62 and Henry successfully argued for Prosecution costs which were ordered in the full sum sought: £31,209.40.
